By using the EMS USB VAULT device and any related software or form generator, you acknowledge and agree to the following terms:

1. Limitation of Liability

   EMS USB VAULT, its owners, partners, affiliates, agents, licensors, and assigns (collectively “EMS USB VAULT”) shall not be held liable for any damages, losses, or claims of any kind resulting from the use, misuse, or interpretation of any information recorded, stored, or displayed using this device or the associated software. Use of this product is entirely at your own risk.

2. User Responsibility for Data Accuracy

   All information stored on the EMS USB VAULT is created, entered, and managed solely by the user. EMS USB VAULT does not review, verify, or ensure the accuracy of any medical or personal data. The user is solely responsible for any and all errors, omissions, misspellings, outdated data, or inaccuracies.

3. HIPAA Exemption and Privacy Context

   The EMS USB VAULT functions as a personal physical information carrier — similar to a printed ID card or medical bracelet. Data stored on the EMS USB VAULT is never uploaded, transmitted, or retained by EMS USB VAULT or any third party. No information is stored in “the cloud” or on external servers. Because it is a user-controlled personal device, use of the EMS USB VAULT does not constitute a HIPAA-covered entity activity. Allowing another person to access the device in an emergency or other situation does not constitute a HIPAA violation. By programming the device with medical and personal information and carrying it on my person, I hereby grant any finder of the EMS USB VAULT and the information stored on it an exemption from any HIPAA and/or privacy rules.

4. Data Security

   Users are responsible for safeguarding their own data, including decisions to use password protection or encryption. EMS USB VAULT provides no warranty or guarantee, express or implied, regarding data security or recovery.

5. No Medical Advice

   EMS USB VAULT does not provide medical advice or certification. It is a personal data storage tool intended for user convenience only.

6. Indemnification

   By using the device, you agree to indemnify and hold harmless EMS USB VAULT, its owners, affiliates, and assigns from any legal claims, liabilities, or expenses arising from your data or your use of the product.

7. No Warranties

   The EMS USB VAULT is provided “as is” without warranties of any kind, express or implied.

8. Governing Law

   This agreement shall be governed by the laws of the U.S. State of Nevada, without regard to conflicts of law.
